Abstract: ان مسالة تعليل الاحكام في الشريعة الاسلامية من المسائل المهمة والتي تضيف الى الشريعة سمة الاصلاح لكل زمان ومكان؛ ومن هنا كان عملي في هذا البحث المتواضع، والذي يمكن ان يستخلص بما يلي : ان تعليل الاحكام ثابت بالكتاب الكريم، والسنة المطهرة، وافعال الصحابة ، ولا يمكن ان يمنعه احد.ان الكلام الحاصل في مسالة تعليل الاحكام، والاختلاف الذي دار بين المجيزين والمانعين، هو خلاف مبناه على تعليل افعال الله تعالى في مسالة العقائد، والتي جرى الخلاف فيها بين المعتزلة واهل السنة على مسالة التحسين والتقبيح، فادخل اصول الفقه فيما ليس منه، فلا بد من دراسة كل مسالة على حدا.ان الاصل في الاحكام الشرعية التعليل سواء في العبادات، او المعاملات وهذا الذي قال به شيخ الاسلام ابن تيمية (رحمه الله)، وثبت بالواقع العملي لدى الفقهاء جميعا انهم يقولون بالتعليل، ولكن منهم المكثر ومنهم المقل، وعلى العموم نستطيع ان نقول بان جميعهم قال بالتعليل بتطبيقه الفقهي، وان خالف في قوله اللفظي.ان مسالة التعليل هي صلب المقاصد، وركنها الركين، ومراعاتها مراعاة للمقاصد الشرعية التي شرعت لاجلها الاحكام.وعلى هذا يعتبر شيخ الاسلام ابن تيمية (رحمه الله) من الموسعين في مسالة التعليل، حتى انه فاق الشاطبي (رحمه الله) الذي اشتهر بمراعاة المقاصد.ان للتعليل اهمية عظيمة، وفائدة كبيرة تتلخص بجعل الشريعة دائمة ومصلحة لكل زمان ومكان، ومن منع التعليل كان جامدا على ظواهر النصوص مما جعله يتكلف القول في بعض المسائل التي لا تقبلها العقول السليمة مثل مسالة استاذن البكر في الزواج فانها اذا صمتت كان في ذلك اشارة على القبول، واذا نطقت بالقبول منعت بحجة مخالفة ظاهر النص!ولا بد من مراعاة النسب الثلاث (الزمان والمكان وحال الشخص)؛ لان الشريعة راعتها، فاذا تغيرت احدى هذه النسب تغير الحكم الشرعي.وعلى تعليل المسائل فان اخراج القيمة في الزكاة اذا كان لحاجة الفقراء، وتحقيق المصلحة من سد حاجاتهم اكثر منها في الامور العينية وجب اخراج القيمة؛ لتحقيق مقصد الشريعة من تشريع الزكاة. وان من افطر بالاكل، او الشرب في نهار رمضان وهو يريد الجماع، وجبت في حقه كفارة الجماع، ولم يكتفي بالقضاء فقط سدا للذريعة.ومن هذا القبيل ذهب شيخ الاسلام (رحمه الله) الى عدم اشتراط الطهارة في الطواف، وعلى هذا جوز الطواف للحائض عند الحاجة، كذهاب الرفقة، او عدم الاستطاعة للرجوع للحج في العام القابل، ونحو ذلك. والقول الراجح هو جواز الصلاة في اوقات النهي اذا كانت من ذوات الاسباب؛ لان علة النهي كانت سدا للذريعة، وما منع سدا للذريعة يفعل عند حصول المصلحة الراجحة، كصلاة تحية المسجد ونحوها، وقد اول احاديث النهي بالتطوع المطلق التي ليس لها سبب متقدم.وان ابدال الوقف حتى المساجد بمثلها او بخير منها للحاجة او المصلحة وكذلك ابدال الهدى والاضحية والمنذور وكذلك ابدال المستحق بنظيره اذا تعذر صرفه الى المستحق والابدال يكون تارة بان يعوض فيها بالبدل وتارة بان يباع ويشترى بثمنها المبدل.وان العلة في التسعير على الناس متعلقة بتحقيق مصلحة ودفع مضرة عنهم، فمتى تحقق ذلك كان على الامام ان يسعر لهم ليس ثمن الاعيان فحسب، بل ادخله بكل ما يحتاج اليه الناس كاجرة الصناع، فان على الامام ان يسعر لهم الاجرة اذواقع ظلم وحيف على الناس.وختاما : فان التعليل جعل الشريعة متسمة بالخلود، والتيسير والتخفيف، فعل من يتصدر الافتاء، او التعليم ان يراعي هذا الجانب لكي لا ينشا جيل بعيد جامد على نصوص الائمة، او متطاولا عليهم، فلا يكون بين افراط وتفريط، بل ليكن وسطا بين طرفي نقيض.وصلى الله وسلم على سيدنا محمد  وعلى اله واصحابه الكرام، وعلى الائمة الاعلام | The matter of justification of Islamic rules (sharia) is considered to be an important matter which adds to sharia the feature of reification in the both timeand place, from here I started my job in this search , which could be extracted as followed : Justification in rules is fixed in holly Quran , in pure suna and in the followers (sahaba) deals, and nobody could prevent if the speech in rules justification and the difference between Forgivers and preventers , is a difference based on justification of Allah deeds within the matter of creeds by which the difference happened between Al Moatazila and people of Al Suna on the improvement and ugly matter , so that Osul Al fiqh is entered, so each matter should be studied separately .The source of sharia rules is the justification whether in worships or treatments as Shaikh of Islam Ibn Taimia mentioned , and it has been proved practically on injustice that they treat within justification.The matter of justification is the base of intentions .so that , Ibn Tamia is considered to be the extensioner in justification matter , in spite of Al Shatiby surpassing who was well - known in observance of intentions. Justification has a great important which could be briefed as making sharia intrest in both time and place , and who prevents justification is considered to be hard at texts outwards which makes him burden in some matters which fine brains couldn't accept them .We should observe the three proportions (time, place and a person's situation) as sharia observed them , and changing one of them , Islamic rule is changed . justification of matters , the value is extracted for poor people need in giving alms and achieving the interest to satisfy them in kinds , to a chief the purpose of Al Sharia from giving alms legislation.Who eats and drinks too much during the day of Ramadan and at the same time he wants to make a sex ,he has to do the expiation of sex .like , sheikh of Islam goes not to stipulate the purity from roaming , that why he allows roaming for menstruating on need , such as going with follower and so on. The contingent saying is to allow to do the pray in preventing times when she has own whys. The reason in pricing on people is related to achieve an interest and at the same time to pay out a harm from them . whenever this thing is achieved , Imam has to price for them not as a price of chiefs , but he makes it as all people need just like the wages of workers and Imam must price a wage for them when injustice falls on then . Finally : Justification made sharia characterize by immortality , facilitation , so who gives a legal opinion or teaching must observe this side in order not arise generation is far off Imams texts . Abstract: الحمد لله الذي بنعمته تتم الصالحات، والصلاة والسلام على من ختم الله به النبوات واكمل به الرسالات، نبينا محمد وعلى اله وصحبه اجمعين والتابعين ومن تبعهم باحسان الى يوم الدين. وبعد ان من الله علي بتوفيقه لي على اتمام هذا البحث المتواضع الموسوم بـ ( اوجه الاتفاق والاختلاف بين المواردي والفراء في فقه الادارة المالية من خلال كتابيهما الاحكام ا لسلطانية - دراسة مقارنة ). الذي اشتمل على مقدمة وفصل تمهيدي وثلاثة فصول اخرى. اود ان الخص اهم ما فيه وكالاتي : • اما المقدمة : فقد بينت فيها اهمية الموضوع، واسباب اختياري له، واهم الصعوبات التي واجهتني اثناء اعدادي لهذه الرسالة، وكذلك بينت خطة البحث، ومنهجي الذي سلكته فيه.• وخصصت الفصل التمهيدي للتعريف بالمصطلح ( الاحكام ) لغة واصطلاحا, ثم التعريف بالمصطلح ( السلطانية ) كذلك، ومن ثم تعريف لمصطلح (الاحكام السلطانية) معا. وبينت ايضا مفهوم ( فقه الادارة ) لغة واصطلاحا، كما ذكرت مقومات الادارة باختصار. •وقد تناولت في الفصل الاول ترجمة موجزة لشخصيتي الماوردي والفراء، فبدئت بالكلام عن عصرهما الذي عاشا فيه من الناحية السياسية والاجتماعية والاقتصادية والعلمية والفكرية. ثم بدئت بترجمة الامام ابو الحسن علي بن محمد بن حبيب، الماوردي المتوفى سنة (450هـ )، ومن ثم بترجمة الامام ابو يعلى محمد بن الحسين بن محمد بن خلف بن احمد بن الفراء المتوفى سنة (458هـ). فبينت اسمهموانسبهما، وكنيتهموالقبهما، والبلدة التي ولدا بها، وانتسبا اليها. وقمت بالتعريف باسرتهما، وذكرت تاريخ ولادتهما، وبينت نشاتهما، وابرز صفاتهمواعاداتهما. وتكلمت عن طلبهما للعلوم الشرعية والعربية، وعن رحلتهما في سبيل اخذهوامعرفتها، وتلقيها عن كبار الشيوخ وائمتها حتى بلغا في ذلك الغاية، وادركا المنزلة السامية، وصارا من كبار ائمة الامة. وتكلمت عن مكانتهما العــلمية. وبعد ذلك ذكرت شيوخهمواتلامذتهموااهم مؤلفاتهموااثارهما العلمية، ثم تكلمت عن تاريخ وفاتهما، ومكان دفنهما.• وقد خصصت ايضا الفصل الثاني والثالث لدراسة وبيان اوجه الاتفاق والاختلاف بين الامامين الماوردي والفراء في موضوع ( فقه الادارة المالية ) الذي يشمل : ( الزكاة، والفيء والغنيمة، والجزية والخراج وعشور التجارة ). وفي هذه الدراسة قمت بالمقارنة بينهمواذلك بذكر ارائهمواادلتهما مقارنا باراء فقهاء المذاهب الاسلامية، وادلة كل فريق مع ذكر وجه الدلالة، وما ناقش به كل فريق ادلة الفريق الاخر، وانتهيت في اخر كل المسالة الى ترجيح احد الاراء، وما فعلته من الترجيح لم يكن ناشئا عن هوى او تعصب لمذهب، ولا فوقية على المذاهب، وانما بسبب ضعف دليل او حديث الراي الاخر الذي اعتمد عليه الفقيه، او لكون الراجح في تقديري محققا لمصلحة معاصرة. وفي الختام اقول : لم ادع اني وفيت الموضوع حقه، وحسبي اني بذلت فيه قصارى جهدي، فما كان فيه من صواب فذلك من توفيق الله وحده، وما كان فيه من خطا فمن نفسي، واسال الله المولى جل شانه المغفرة. | Praise God that His grace is righteous, and prayers and peace be upon the seal of God by prophecy and completed by the messages, our Prophet Muhammad and his family and companions and followers, and followed them in truth until the Day of Judgement. Which included an introduction and an introductory chapter and three other chapters. I would like to summarize the most important of which are as follows : • The Introduction : It has demonstrated the importance of the subject, and the reasons for his optional, and the most important difficulties that I faced during my preparation for this message, and also indicated the research plan, and systematically taken by it.• The introductory chapter devoted to the definition of the term (Conditions) language and idiomatically, then the definition of the term (Bowl) as well, and then the definition of the term (provisions Bowl) together.The concept also shown (jurisprudence Administration) language and idiomatically, as I mentioned briefly the elements of management.• The first chapter dealt with in a summarized translation of the characters, talking about their time they had lived in terms of political, social, economic, scientific and intellectual. Then initiated the translation of Imam Abu al - Hasan Ali bin Mohammed bin Habib, Al Mawardi who died in (450AH), and then translating Imam Abu Yaela Muhammad bin al - Husayn bin Muhammad bin Khalaf bin Ahmed bin Al Farra died in (458 AH). Whose names and she stated their parentage, and surname, the town where they born, and belonged to it. And I defined their family, and stated date of their birth, and showed their emergence, and highlighted the qualities and spoke about the request of Forensic Sciences and Arabic, and the trip to be taken and knowledge of, and received by senior elders and imams until they reached the end, and realized the status of the great scholars , and have come from senior leaders and spoke about their scientificpositions And I mentioned their teachers, students and the important scientific implications, then spoke about the history of their death, place of burial.• It has also devoted Chapter II and III of the study and statement of agreement and disagreement between the Imams Mawardi and farra on the subject (the jurisprudence of financial management), which includes : (Zakat, and booty, and the poll tax, levy and (on tenth) Commerce). In this study, I compared them by mentioning their views and evidence for comparing the views of scholars of Islamic sects, and the evidence for each team with an indication of the significance, and discussed by all team guides the other team, and finished at the end of each issue to the likelihood of a consensus, and the action of the weighting was not emerging on or intolerance to the doctrine, nor to the doctrines of superiority, but because of weak evidence or other opinion talk, which was adopted by al - Faqih, or the fact that the correct view in my opinion the interest of contemporary interest.In conclusion, I say : I did not let the right topic and that I made it my best, what was the right of it from the help of God alone, but if it was wrong, it is myself, and I ask Allah the Almighty would forgiveness.The last prayer is praise be to Allah, Lord of the WorldsAnd blessings of Allah be upon our beloved Muhammad and his family and him.

Abstract: الحمد لله الذي اتم لنا نور الاسلام واعان المسلمين .بقوله (اياك نعبد واياك نستعين )والصلاة والسلام على حبيب رب العالمين القائل ((كل ميسر لما خلق له )) فلا تزال كثيرا من الامور تشغل فكر المسلم بما يتجسد من مخالطات وتلاقحات فكرية ؛فلابد للمؤمن ان تتضح له السبل التي يحق له مزاولتهواتتضح له مسالة القدر الالهي ؛وتنزيه الباري عن الشرور التي تقع بفعل الادميين ،ولذلك وقع اختياري للاطروحة الموسومة ((الموازنة بين السببية والتوكل على الله واثرهما في الفكر الاسلامي)) وقد وقع الاختيار على هذا العنوان بعد الاستشارة والتقصي عن عنوان يتناسب وما قد كتبت من بحوث في مرحلة الماجستير والمختصة بالعقيدة الاسلامية ، وقد حاولت ان ابين في ما بذلت من الجهد المقل ما لقانون السببية من اثر في حياة الانسان وحيث تلك السنن الالهية التي فطر الله الناس عليهواالتي حثنا القران الكريم والسنة النبوية على الاستزادة منها، ونظرا لما نلحظه من كلام بعض الناس ان حسبه التوكل وضنا من ذلك الناطق بهذه العبارة ان الاخذ بالاسباب يتعارض والتوكل ، او ان الاخذ بالاسباب ينافي الايمان بالقضاء والقدر ، وحيث ان الله له الخلق والامر ، ولا تبديل لخلق الله ، ولا تغير لحكمه فقد جعل اسبابا قدرية على احكامها التي اجراها على اسبابهواما خلقت له ، وبذلك نجد هذه الموازنة لقوله تعالى ( فلن تجد لسنة الله تبديلوالن تجد لسنة الله تحويلا ) 0 (فاطر 43) فالمسببات مرتبطة باسبابها شرعواقدرا ، ولذلك فطلبها من غير اسبابها مذموم كما ان انكار الاسباب لان تكون موصول لغايتها امر مردود ، بل ان النتائج المترتبة على انكار قانون السببية كافية لهدم حقائق العلوم كلها ، فان العلوم جميعها تستند الى هذا القانون ، يقول ابن رشد الحفيد في خطورة انكار الاسباب (ان من رفع الاسباب فقد رفع العقل وصناعة للاسباب تضع وضعا ان هاهنا اسبابوامسببات ، وان المعرفة بتلك المسببات لا تكون على التمام الا بمعرفة اسبابها ، فرفع هذه الاشياء مبطل للعلم ورفع له ، وهي ناتجة عن الجهل بالشرع وبالسنن الكونية ايضوابخلط المفاهيم بعضها ببعض 0 وتتمثل تلك الامور في مظاهر عدة : 1 - القول بالجبر وان الانسان بالنسبة لتكاليف الشرعية كالريشة في مهب الريح 0 وهو ما سنذكره فير الراء الكلامية في القضاء والقدر 2 - القول بالتنافي بين قانون السببية والقضاء والقدر ، وقد وضحت ذلك بذكر موارد من المسائل في الفصل الثاني من الاطروحة 3 - الركون الى التواكل والكسل الناشئين عن الخلط بين الاحوال الدينية الاخروية وبين السنن الكونية الدنيوية وهذا ما سنحاول ايضاحه في الفصل الثالث من الاطروحة وهنا نحاول ابراز ما هو في ما فرض الله على العباد ، وما اشار عليهم بتوجيه اليهم كعمل دنيوي تنتظم به حياة المسلم 4 - توصلنا الى ذكر اراء الفرق الاسلامية فيما له العلاقة في الموضوع من القضاء والقدر ، وكذلك ذكر الاراء حول الاخذ بالاسباب والتوكل على الله عز وجل .5 - هناك اسباب ما نسميها بالسنن الكونية الثابتة بالكتاب والسنة ، ومن هذه السنن منها ما هو صلب الدين من حيث العقيدة ، وهي اركان الايمان ، وكذلك اركان الاسلام ، ومن حيث الاحكام الخلقية ، فهذه الثلاثة لا نزاع فيها ، واما الجوانب الدنيوية ، من حيث النظم ، وهي النظام الاخلاقي والنظام الاجتماعي ، والنظام الاقتصادي ، والنظام السياسي . 6 - ومن خلال ما ذكرناه نجعل في جميع مكونات المجتمعات موازنة في اعتناق الدين ومسايرة الحياة العملية ، وهي تحت قولنا اعمل لدنياك كانك تعيش ابدوااعمل لاخرتك كانك تموت غدا ، اي ان نعيش بين الخوف والرجاء ولله الحمد والمنة من قبل ومن بعد . انه بر جواد رحيم. | Praise belongs to Allah ,Who completed the message of Islam and support Muslims as He says : "To thee we serve. On thee we rely for help"(Alfatiha.Ayat : 4).And may bless and peace of Allah be Upon His prophet, Muhammad, who says : "Everyone is com upon what he is created for". A lot of thing still fill and disturb Muslim's mind, as those embodied in the intellectual combinations. So, every Muslim should behold clearly the ways he wants to travel along to unveil the issue of the Fate, and to keep Allah far above wrongdoings committed by human beings . Thus I submitted this thesis titled "The coordination by human beings Thus, I submitted this thesis titled " The coordination between undertaking means and reliance on Allah and the effect in Islamic thought ", choosing this title after consulting and finding out a title that comes in line with what I had written in master stage about Islamic Ideology . I tried to show , in humble effort , the effect of the concept of "undertaking means " in mankind's life, as it is the nature of him and Holy Quran and the prophetic Tradition urge us to give it more attention .Some people think that undertaking means disagrees with reliance and believing in the Fate, as Allah the absolute power of creation and giving orders and His creation and judgment are unchangeable, as He says : "There is no change to Allah's rules" (Surat Fater : Ayat : ). The results depends on their means from the view of the religion and fate ,so ,to ask them from other means is insensible, and to deny that means lead to their ends is unacceptable. The consequences of denying the concept of " undertaking means" are enough to destroy all sciences ,since all kinds of knowledge depends on this concept. Ibn Rushd Alhafeed says in the seriousness of denying undertaking means : "Those who deny means are denying mind,and reaching the results completely depends on means. So ,to deny these things is denying knowledge, and that happens because of the ignorance in Islamic laws , universal rules and mixing concepts with each other".These things are embodied in the following : 1 - Believing in Jabr, and human being ,according to religious, is like a feather in the wind This is what we explained in the ideological opinions of the fate.2 - Believing in disagreement between the concept of "undertaking means" and the fate. I explained this in chapter two off this thesis.3 - Leaning on laziness arising from confusing the religious, divine things with universal, earthly things .This is what I explained in the third chapter of the thesis showing what Allah ordered man to do ,and what organizes Muslim's life.4 - We mentioned the opinions of Islamic sects concerning the issue of the fate and mentioned the opinions about undertaking means and rellance on allah the almighty . there are the ristricted universial rules mentionedin the Quran and the prophetial tradition . some of these rules are obligatory in blieve , such as blieving ( Eman ) items , Islam items , and other uncontroversial rules . 5 - the other controversial rules are the ethetic , social , economical and political systems 6 - Au a result we must make a balance in the communities to act along with the religion and the practical life . It is as said “ work for the life before death as you will forever . work for life after death as you will die tomorrow .

Abstract: طالما جنح بي طائر الخيال، وابحرت بلبي سفن الامال في عباب بحر الشريعة المتلاطم الامواج، ذلك البحر الزاخر بابهى اليواقيت واغلى الدرر، وهاقد اصبح هذا الطموح واقع حال اعيشه واجني ثمراته اليانعة، فقد حظيت بشرف تحقيق قسم من كتاب مهم في الفقه الاسلامي على مذهب الامام الاعظم ابي حنيفة النعمان (رحمه الله)، من مخطوطة قاست من الركون في رفوف المكتبات الامرين، ونفض غبار الزمن من ثناياها؛ كي تخرج مشرقة مضيئة الى عالم النور، وتساهم في اغناء الباب الدارسين فيما يخص فهم احكام شريعتنا الغراء. ومنذ ولوجي في مضمار الدراسات الاولية ثم الماجستير كانت الرغبة ملحة في تحقيق اثر من اثار ساداتنا العظام بدلا من كتابة رسالة من انشائي تخص زماننا الحاضر وذلك لعدة اسباب : اولاها : بعث الروح في تحفة من تحف الزمن الماضي فيها الكثير الكثير ممايفيد الدارسين والمتعلمين ممن ينشدون الكمال في العبادات .ثانيها : الرغبة في التحدث للمجتمع بافواه اولئك الافذاذ، لابافواهنا نحن، فهم الورعون الزاهدون الناهلون من معين القران الكريم والسنة المطهرة.ثالثها : قرب عصر المؤلف من عصر النبوة يجعل في كتاباته شيئا من انوار الشمس المحمدية(صلى الله عليه وسلم) التي اضاءت بصرى والشام، بل ملاء نورها الخافقين.رابعها : الافادة من اسلوبهم في الكتابة، ذلك الاسلوب الشيق الذي ينم عن همة علية وبلاغة متناهية النظير.خامسها : احتواء المخطوطة على مسائل دقيقة في الفقه .سادسها : اذا كان اصحاب خير القرون اتحفونا بامهات الكتب في شتى المسائل فلاغنى لنا ان نسعى ونحث الخطى باظهار تلك الكنوز بما نلهم به من الباري ـ عز وجل ـ ونشرع بتحقيق ثمرة من تلك الثمرات . وقد شرعت بتحقيق هذا الكتاب وكان منهجي فيه كماياتي : اولا : قدمت على قسم التحقيق قسما يتضمن خمسة مباحث وتناولت في المبحث الاول : لمحة عن حياة المصنف .وفي المبحث الثاني : لمحة عن حياة الشارح .وفي المبحث الثالث : وصف النسخ الخطية للمخطوط .وفي المبحث الرابع : منهجي في التحقيق . وفي المبحث الخامس : سبب اختياري الكتاب . ومن الواضح ان حياة المصنف والشارح مختصرة وفيها شيء من التقصير، وذلك لعدم وجود ترجمة وافية للمصنف والشارح في كتب التراجم .ثانيا : النص تحقيقواتعليقا، وقد ذكرت عملي فيه في المبحث الخامس بشكل مفصل . وقبل ان اختم هذه المقدمة اود الاشارة الى انه قد سبقني احد الطلبة في اخذ القسم الاول من هذا الكتاب (الطهارة والصلاة والزكاة) دراسة وتحقيقا.وكذلك اشير الى انه لم اقم الا ببعض الخدمة في رحاب العلم والعلماء على الرغم من الصعوبات التي واجهتنواالظروف التي احاطت بنا، ولاازعم انها خلت من الزلات، ولكني ازعم اني بذلت فيها جهدي في داب واخلاص ، فمواجدت فيها من معالم الجودة فبتوفيق الله وفضله، وغير ذلك فمن نفسي ومن تقصير جهدي . والله من وراء القصد انه نعم المولى ونعم النصير .

Abstract: Allah has explained to all nations the reality of its religion and has explained everything . In His Book ( Quran) , there is guidance , lightness and there are some people claimed ignorance in some matters , these kind of people are unexcused , but those who have recently entered Islam , they might be excused as that mentioned by " Imam Al - Syuti" Allah's mercy upon him" . Thus , the illiteracy and ignorance are the main enemy to human and Allah has implanted an instilled strength of awareness that surpasses other creatures; if a human asks for a science , he confirms his humanity and if he leave the science , he lacks his humanity . The science facts across times would be lost , and getting the rituals meaningless and such features would be of nothing . thus, our God will discipline those people who got away from their understanding and their eyes get strayed , away from the right path . As Imam Ahmed said " The religion of the prophet Mohammed are tides That would be considered as helpful for the people Wishing not the talk and its means The opinion is night and the talk is day.Might the young be ignorant of the right path The sun shines ,having lights Thus, the matters , Islam came with , shown by the prophet ( peace upon him) and being explained by Quran among the Muslims , accept the claim of ignorance . If the people claim ignorance in respect to the prayer , fasting , and pilgrimage , such claims are not to be accepted at all since such matter are known by all Muslims and such matter explained by Quran . The ignorance in Allah is no more than polytheism and it is considered as a trap place by the devil to human . The ignorant thinks the mischief is useful to him and the useful thing is mischief one. Sufyan Al - Thawri" ( Allah 'mercy upon him) said " Beware the temptation of the infidel and the temptation of ignorant worshipper . Allah urges to knowledge and sciences and He shows the prestige of the scientists and the great goodness they will get ; He criticized the ignorant and to be aware from him . Of the scholars who encouraged on knowledge and science was Imam Al - Shafaaee who said " If one does not test the bitterness of learning , he would be ignorant throughout his life , and if anyone lost teaching and learning during his life time , then he will suffers a great deal all his late life. Thus, I have selected this subject for its significance and importance and I have summarized some important points : 1. Supplying with the useful science on God's will. 2. The ignorance is within the humans , despite spreading means of cognition , some people still stick to the ignorance. Abstract: دراستي الموسومة نصرة المظلوم في فكر اهل البيت (عليهم السلام) , ان ائمة اهل البيت (عليهم السلام) لهم الدور البارز برسم الخطوط العريضة للحياة الانسانية الناجحة عن طريق توجيهاتهم السديدة والمؤثرة في النفس البشرية وان نصرة المظلوم من اهم الواجبات الشرعية ، وهو من افضل العبادات ، وانبل الطاعات ، وهو من اهم الاساليب في منع الرذائل ، وانتشار الفضائل ، وزرع بذور الخير والصلاح في المجتمع ، وقلع جذور الشر والفساد والتحلل الاخلاقي من البنية الاجتماعية . وفي القران الكريم نجد العديد من الايات الشريفة التي تدعو للقيام بفريضة نصرة المظلوم وذلك بهدف نشر الحق والفضيلة والصلاح في المجتمع ، ومحاربة وقلع الظلم بمختلف اشكاله والوانه وصوره. ان فكر اهل البيت (عليهم السلام) الذي هو مجمع الفضائل لا يغفل هذه الناحية العامة من الحياة السعيدة ، انه يحث الناس على ان ينصروا المظلوم ، حتى يشيع المعروف في المجتمع ، كما انه يامر ايضا بالنهي عن الظلم للمحافظة على نقاء وطهارة المجتمع الاسلامي ، وبقاء البركة فيه , كان ذلك الدافع الذاتي حفزني على البحث والدراسة في ذلك الموضوع لما فيه من الاهمية العظيمة في وجوب نصرة المظلوم وردع الظالم عن ظلمه في ضوء فكر اهل البيت (عليهم السلام) . وقد قسمت رسالتي الموسومة على مقدمة واربعة فصول وخاتمة وملخص الرسالة . احتوى الفصل الاول الموسوم بمفهوم نصرة المظلوم في فكر اهل البيت (عليهم السلام) , حيت تناولت فيه التعريف بالنصرة والمظلوم والفكر واهل البيت (عليهم السلام) وفضائل اهل البيت . اما الفصل الثاني الموسوم باهمية نصرة المظلوم وادلتهواحكمهواشروط الناصر وانواع النصرة , حيث بينت فيه اهمية النصرة وكذلك ادلة النصر من القران والسنة المطهرة واقول العلماء , ثم تناولت ادلة النصرة وشروطهواانواعها .والفصل الثالث : الموسوم بمفهوم الظلم ودواعيه وانواعه , حيث ضم التعريف بالظلم وكذلك من انواع الظلم والاسباب والدواعي التي تدعو للظلم . اما الفصل الرابع الموسوم بمنهج اهل البيت (عليهم السلام) في مقارعة الظلم ونصرة المظلوم واثرها , ولقد بينت فيه مقارعة النبي (صلى الله عليه واله وسلم) للظلم وكذلك تصدي الائمة (عليهم السلام) وحرمت معونة الظالم , وكذلك احتوى الفصل على اقوال اهل البيت(عليهم السلام) في نصرة المظلوم وكذلك افعالهم في الحث على نصرة المظلوم وايضا ذم تارك النصرة والاعانة لا تنحصر بالمستغيث فقط , وتناولت فيه ايضا اثار الظلم والنصرة المظلوم اما الخاتمة فانتظمت في امرين، الاول : اهم النتائج التي توصلت اليها في هذه الرسالة، والثاني : التوصيات التي ارجو من المربين والمسؤولين عن سير العملية التربوية للمجتمع بصورة عامة الاخذ بها للبلوغ بالمجتمع المسلم الى درجة الكمال الانساني التي سعى لها الدين الاسلامي والثالث : ملخص الرسالة | My study is marked by the victory of the oppressed in the thought of the people of the house (peace be upon them) The imam of the people of the house (peace be upon them)have a prominent role in drawing the outlines of a successful human life through their sound and influential guidance in the human psyche and supporting the oppressed is one of the most important duties of legitimacy. Worship, and nobility of worship, which is one of the most important methods in preventing vices, spreading virtues, sowing the seeds of good and good in society, and uprooting the roots of evil, corruption and moral decomposition of social structure. In the Holy Quran we find many of the noble verses that call for the duty to support the oppressed in order to spread the truth, virtue and goodness in society, and fight and eradicate injustices in all its forms, colors and images.The idea of the people of the house (peace be upon them), which is the compound of virtues, does not overlook this general aspect of happy life. It urges people to support the oppressed so that it is known in society. It also enjoins the prohibition of injustice to preserve the purity and purity of the Islamic community. The self - motivation motivated me to research and study on that subject because of the great importance of the necessity of supporting the oppressed and deterring the oppressor from injustice in the light of the thought of the people of the house (peace be upon them). My thesis was divided into an introduction, four chapters, a conclusion, and a summary of the message. The first chapter, entitled "Support for the oppressed", was included in the thought of the people of the house (peace be upon them), in which it dealt with the definition of victory, the oppressed, the intellect, the household, and the virtues of the people of the house. The second chapter deals with the importance of the victory of the oppressed, its equivalence and ruling, and the conditions of the Nasser and the types of victory. It showed the importance of the victory, as well as evidence of victory from the Qur'aan and Sunnah.Chapter Third : The concept of injustice and its causes and types, including the definition of injustice as well as the types of injustice and reasons and reasons that call for injustice. The fourth chapter, which is marked by the approach of Ahl al - Bayt (peace be upon them), is against oppression, support for the oppressed and its impact. It has also shown that the Prophet (God prays on him) was opposed to injustice, and the imams (peace be upon them) resisted and denied the aid of the oppressor. (Peace be upon them) in the support of the oppressed as well as their actions in urging the support of the oppressed and also the injustice of those who left the victory and the subsidy is not limited to the needy only, and also dealt with the effects of injustice and the wronged victory The second conclusion is the recommendations that I ask educators and those responsible for the educational process of the society in general to take into account the maturity of the Muslim community to the degree of human perfection sought by the Islamic religion and the third : Summary of the message .

Then I mentioned the conclusion in which the most important thing reached and I may have written and stood up and agreed so what was in the search of true or repaying opinion it is from God Almighty , and if it is a mistake or a slip or a shortcoming it is from me I am not claiming perfection , but God alone , and praise be to God , the lord of the worlds.

The birds have different properties , Hoopoe is Ayah of Allah 's Ayahs that being exploited for human beings , this bird was transferring news to the prophet " Sulaiman"( peace upon him), the ant and other small creatures enduring the difficulties . The fly is created by Allah and this indicates to his supreme greatness despite its smallness in size and in body. 5. The human , Allah has wonderfully created him . each part in a human indicates to the miracle of Allah ; the original of human is dust and Allah created the human through three darkness stages( uterus , Placenta and Abdominal ) .Allah made senses for human beings that being considered as witnesses on doomsday ( hearing, sight , skin) . When some had said (the Companions' justice), they aimed to legalize all their saying and actions to fulfill their personal or group interests in spite of their contradiction of their saying and actions with each other, on one hand, and with the heavenly instructions, on the other hand, as Imam Al - Sadiqh had said (they did not worship them, yet they legalized the forbidden, and forbidden the legal), with clear offenses to the saying and instruction of the great messenger Mohammed (P.U.H). So, the only resolution was to obscure and confuse the names by saying (so and so), or what is so called in Arabic (Fulan), intentionally or unintentionally, to maintain the actions of the previous and to obligate the followers. They had treated Ali and other members of Ahlul - Bait( P.U.Th) in a way that was different from that with which they treated the other companions. The prophetic heritage had been subjected to a great series of attempts to obscure the names to be neglected and forgotten.The research concludes a number of results that could be summarized as following : - 1 - The word (fulan= so and so) is used to replace the name of the person or the character whom they are talking about; if it was a female it would be(fulanah), it has a historical root as it was used in the Hebrew and Syriac language.2 - Conventionally, (fulan) is used to obscure the characters in the narration texts and chains, intentionally or unintentionally.3 - It had been used in the holy Books, before the holy Qur'an in which it had been used once in Al - Foorqhan sura : verse (28).4 - There are different terms that refer to obscureness such as a man , an old man, someone, several persons and others. Moreover there are some practices that are close to obscureness like changing characters, distorting or omitting names, cutting the narration, mentioning the attribute without the attributed, using the participate and so on.5 - In addition there are some hadithi terms that refer to obscureness.6 - Studying Al - Fulaniat has many interests; this research enables to define them to be its targets.7 - The famous books, such as Al - Jami'e Al - Saheeh for Sheikh Al - Bukhary had used Al - Fulaniat; it had been mentioned (241) times : (148) times in the narrations; text and (3) times in the chain.8 - The source of Al - Fulaniat could be the narrators, the classifiers and the writers or typists.9 - The researcher was able to recognize a number of Al - Fulaniat with their names concluding that it is good for the evil persons to obscure their names, but it is not so for the good and pure persons.10 - The reasons for using Al - Fulaniat are political, doctrinal, tribal or personal. Imam's contribution was not limited to the legislative side only. It surpassed to outstanding judicial one in applying these legal systems and rules on the issues which were offered to him that they fructified in spite of the short period of his reign. The commander of the faithful ( peace be upon him ) could stretch security and stability and keep the individual's rights away from misleading that these procedures did not harm or cause wrong to anyone because they rested on the legal decrees of fighting against crime. The result of those punishments was that the Islamic nation was blessed with security and tranquility in addition to the decreasing number of the accused and the punished in society. Besides , few adulterers were stoned and few thieves whose hands were cut That was the great impact of purity that limited prevalence of crime in a society vulnerable to corruption and deviation.

He will inevitably study the evidence of this interpretation and analyze it to determine its validity. Therefore, the analytical interpretation is related to the interpretation in that it is a path to the validity of the results of that interpretation.10 - Each interpretation has special mechanisms that do not depart from it. The mechanisms of analytical interpretation are many, such as the linguistic mechanisms. We propose to study the verses of faith in the Qur'anic text by employing the method of analytical interpretation that if this approach is employed correctly and if it is put on its optimal path then it will be the best and the most effective method in the statement of the most obvious meaning, rather than the verses of faith. To solve many of the problems that are related to the verses of faith and their interpretation.3. We call for the use of the method of analytical interpretation within the scope of the study of explanatory criticism that the researcher has stood on a number of opinions is not good interpreters what is needed for critical reading and accurate and this task is only entitled to the method of interpretation of the analytical so I call for the use of interpretive criticism in general.4. We recommend the academic staff competent ministries of higher education and education as the subject of analytical interpretation material of the subjects of study which is a curriculum that makes students in the Islamic sciences, as well as the scientific and research institutions to take care of it and any explanation for being rooted roots of the people of the house (peace be upon them) Must be introduced and developed.5. This led the study to be varied between the analytical, objective and descriptive method.The study is divided into a preface and three chapters. The preface included revealing the basic concepts of the title. In it the origin of narration and its roots in the Arab and western thought through referring to its historical path and its rise.The first chapter came under the title “Inimitability and the Nature of the Koran Stories”. It is an attempt to reveal the Koranic Inimitability, on one hand, and the Koran Narrations Inimitability, on the other. The chapter included six sections.The second chapter is entitled “the Structural Inimitability in the Koran Narrations Inimitability” which is an attempt to reveal the Koran Narrations Inimitable narrative structure of the Koran stories, taken the story of Mousa as an example for application, it also included six sections.The third chapter, “the Features of the Narrative Koran Narrations Inimitability in the Koranic stories” discussed some of the stylistic features of the Koranic text taken the story of Mousa as an example for application, it also included six sections.Finally, the research is concluded with a conclusion in which the main results are mentioned followed by a list of references. The main results reached through the study are; Inimitability of the narrations lies in its uniqueness in the Koranic text which has no match ever. As for the element of time, each story in the Koran has its own time and the time element in the Koranic story is absolute which has no ties except for the past. This is proved by evidence from the Quran and the prophetic tradition.6 - The condition of flaw can be true for the seller to and follows the same rules which cannot be valid unless several conditions are met.7 - In case the deceit in the contract was proven, the contractor has the right to demand refund in case it was impossible to return the commodity, otherwise he has the right either to return the commodity or demand refund to decrease the damage.8 - If the product is sold for much more than its value, the buyer has the right to return the product. This is proved by evidence from the Quran and the prophetic tradition.9 - The jurist did not agree on this right, some applied it to all types of transactions and other to the cases when the price is much higher than the value of the product, and this is valid when all the demanded conditions are met.10 - The jurists agreed on the right of testing the product and in case something was wrong with the product, the contractor has the right to repeal the contract, this also supported by several evidence and demands several conditions that should be met.11 - I mentioned all the alternatives devised by the jurists without mentioning the evidence of each one. The first alternative mentioned is the right to repeal the contract in case the both parties are still in the same venue of signing the contract.12 - Some of the jurists has agreed to the previous right supporting their opinion with several evidence and in analogy with the opinion of the prophets companions who supported this right, while others rejected it saying that the contract would be obligatory right after it is signed by the approval of both parties. 13 - This option is valid in all types of transactions and not in other domains as it lacks evidence for that like the contracts which implies the probability of repealing in its nature. This right is conditioned by several terms.14 - The alternative of conditioning is proved by different ways that one of the contractors can set a condition to have the right to repeal the contract within a certain duration and is permitted for both the seller or the buyer or a third person. Abstract: The researcher concludes a set of important results that could be summarized as following : - 1 - The primitive principle of things, dealing with arts is one of them, is permission, allowance and concessionary for the majority of jurists, except Al - Sayed Al - Sader who believed on practice continuous cause. 2 - The Usuli Imamates agreed that the legal principle is allowance, permission and exemption, which contradicts the Akhbaris3 - Islam revives the feeling of beauty, supporting the fine art, yet it should be according to legal conditions that the heavenly laws put.4 - The jurists have different opinions upon representation, drawing or portraying, ending with four opinions; they agreed upon the forbidding of the embodied drawing of the creatures of soul; perfect of semi - perfect.5 - From the jurists` opinion upon the drawing forbidding cause it is understood that it has two resources, no matter that the drawing is embodied or not : - the first is because they are put to resemble the Great Creature, which the suitable meaning for the hadiths of breathing the life in it, and the second is because they are put to magnify certain figures in a way that resulted gradually to worship them rather than His Almighty God.6 - According to what is mentioned above, it is allowed to put embodied pictures or statues for the things with soul for reasonable or scientific reason as ends justify means; like teaching, learning, entertainment or maintaining the nation history and civilization. 7 - The primitive principle of ornamentation or decoration and Arabic calligraphy is permission and allowance as there is no legal evidence to forbid them.8 - Been forbidden, the embodiment is substituted, by the Muslim artist, with the plane drawing, depending on ornamentation or decoration, by modifying the natural figures in an abstract way that keep it far from illegality.9 - For photographs, the primitive principle is allowance as there is no legal evidence to forbid it, unless its subject was forbidden such as to magnify certain figures especially if they were bad people.10 - photography is not forbidden as it considered of the age necessities; to achieve the formal documents such as the I.D card and the pass port and so on, in addition to be a teaching aid and a means to maintain the legal rights like the pictures of the unanimous dead people that are shown to be recognize by their relatives.11 - The effective cause of forbidding singing, is the amusement or pastime which is whatever makes Man beyond his natural statue poetry prose or music.12 - Some of the musical tools, like tambourine and drum, could be used in the weddings, it is recommended to use them in wars.13 - The common tools or instruments, that are use for the forbidden ( haram) and non forbidden ( halal), and not restricted for the first case, such as the radio or T.V, evidence of the holy Qur`an and hadith should be considered regarding fun and laugh. are allowed to be sold and bought14 - Acting, in theater or television is, in the first instance, not forbidden, yet it should not be accompanied by forbidden things, that could not be restricted or defined, such as man and woman association or social intercourse, and music as well as the subject or the theme which should not contradict the pure doctrine and the Islamic instructors or praising or magnifying oppression and injustice, otherwise it is not forbidden. 15 - There is additional conditions for theater acting in particular, where the

Abstract: ان تاليف كتب المشيخة مهمة جدا في تصحيح اسانيد الكتب الروائية - وخاصة الكتب الاربعة ؛ لان المشيخة من المناهج الرجالية المتبعة في تصحيح الاسانيد فهي مثل فهارس الكتب والمصنفات الى اقوال الرجاليين - الا ان الفهارس اعم من المشيخة.كما ان شهرة الكتب والا | The study concludes a number of results that could be summarized as following : - 1 - Throughout studying criticism, in general, the literary and the prophetic hadith in particular, it became clear that narrating, then criticizing, the holy narration had an important effect on the Arabic criticism literature development.2 - Composing the Sheiks books is a very important step in ratification the narrative books chain, especially the four books, because Sheiks books is of the followed hagiographic methods in ratification chain such as the books bibliographic, classifications and hagiographic, yet the bibliography is more general than Sheiks books.3 - The fame of the books, principles and classifications is, for the earlier scholars is sufficient that the chain could be neglected, yet the chain that the classifier referred to could be mentioned, especially that some of the late scholars. After Al - Toosy, had depended on the chain and the methods.4 - Al - Sheik Al - Sodooqh is the first who put the book of Sheiks books to be attached to his Al - Faqhiyh as a new method that support his book authentication and a way to the books and classification. There is no former attempt in this field save what was ascribed to Sheik Hasen bin Mahboob Al - Terrad ( Kottob Al - Mishiyakha) which is of the missing books, and that of Ja`fer bin Basheer Al - Bajelly which also missed.5 - Al - Sheik Al - Sodooqh has mentioned most of his methods to the authors of the principles in Sheiks books some of them is known in the famous bibliographies of his period which most of them are lost after the fourth century of Hegira. 6 - The Sheiks of Al - Estbsar is a repetition of the Sheiks books of Tahdheeb Al - Ahkam, but Al - Sheik Al - Toosy had combined in his two books between the method of Al - Sheik Al - Kulainy in his Al - Kafy by mentioning the chain in full and the method of Al - Sheik Al - Sodooqh in his Al - Faqhiyh by refereeing to the Sheiks books or the bibliography to supplement the chain of his two books narrations.7 - Most of the methods of Al - Sheik Al - Sodooqh II in his Al - Faqhiyh are that of the sector Sheiks in Al - Tahdhibeen as well as referring to the masters of Al - Kulainy who are mentioned in Al - Tahdhibeen.8 - Al - Kulainy had has mentioned most of his methods to the authors of the principles in the chains of his Al - Kafy, they are agreed, sometimes, or disagreed, in another times, so that would facilitate recognizing considerable methods to be adopted, and the weak or unanimous to be studied. Abstract: Most of the attention of the religious modernizers, who still believe on the religion importance in Man's life, is paid towards attempting to put the theory of (historical) as a rule so as to find an approach to legalize the contemporary problems religiously. Throughout the research, we found that there are four opinions upon the (historical) of the religious knowledge (the holy Qur'an and Sunnah) : The first opinion : - the origin of the religious knowledge is the historical, unless the evidence proves the opposite, this is the opinion of the modernizers; secularists and religious, Muslim and non Muslim, Sunnite and Shiite, with the difference of their extremity in this opinion. Some deny completely that the Islamic knowledge is a Divine knowledge, some believe that they are Divine knowledge but they are put for certain era so their validity is expired with the end of that era and the human mind is responsible for taking the good of its judgments, some believe that they are mixed of Divine knowledge and human knowledge, and some believe that they are Divine knowledge on the theoretical levels, become human knowledge on the application level, change according to the historical variables. The seconds opinion : It is the opposite of the first opinion, rejecting the historical of the Islamic knowledge completely, the founders of this opinion, who are mostly jurists; they believe that the origin of the legal judgments is the fixedness, unless the evidence proves the opposite.The third opinion : - believe that the origin of the legal judgments is the fixedness, and the subjects are discussed; the jurist must define the subject then give it the judgment, the worshipping subject could not be historical, while the social subject could be historical.The forth opinion : believe that the origin of the legal judgments is neither historical nor non historical; the researcher and the evidence should prove either that the historical conditions affect the judgment subject or not. If there is no evidence, so the origion would be neither this nor that. The research concludes a set of results that could be summarized as following : 1 - The modernizing thought is not a new creation or a new idea in the world of thought; it is a repetition of the human thought in all ages. Some of the questions that are aroused today are the same as that had been aroused in the age of the prophet Mohammed (P.U.H) when the disbelievers of Quraish accused him as a (poet), as the poet has a wide imagination that enable him to create idea that goes beyond the imagination of the ordinary people, so they had said he had created or fabricated the holy Qur'an as it had been mentioned in the holy Qur'an which refuted them and challenged them to present something like the holy Qur'an. These questions are also like the previous theorizations and defamations where some had fabricated narrations and the other had interpreted them that the prophet could not manage the worldly problems by himself so he had counseled his fellows and get use of the others' experiences. So we can say that the human thought repeated itself with the difference of terms and manner. 2 - Thought could not be countered save by thought so the modernizers' hypotheses must be faced by a counter thought that would not result in increasing the extremity of certain party. Some of the modernizers are looking seriously for the truth, believing that religion must have a role in the people daily life. The holy Qur'an and the prophetic tradition, as well as the biography of the infallibles, are immortal example of facing the odd or unusual ideas with kindness. Hence each one, of the modernizers or others, who demand looking for truth should follow these three resources to reveal truth. Yet there are some modernizers who had nothing to do with religion, they deal with it to get it out of its real significance and content. 3 - Believing that the prophet is a human does not affect his infallibility, this aspect could not be a subject of judgment though some jurist consider it in the field of recommended and unrecompensed as the time of his sleeping, the kind of his food and so on; these are so personal things that could not be followed unless he had recommended to do or not to do it. 4 - History, as a concept, is not rear for the jurists' theorizations, though it had not been invested within the rules of deduction. So it is possible to put this theory in the curricula of the Hawza study if the Usuli scholars define the limits of this theory within the frame of the religious legislation and root it as a base or a principle within the rules of the science of principles. This needs a courage like that of Ibn Idrees who had discussed the opinions of Sheikh Al - Toosy, that of Al - Khoo'y who had discussed the jurist opinion in consensus and famous or that of Al - Khoomayny who had entered the effect of time and place on changing subject.

The martyr Al - sader had followed him.6 - For the problem of the delayed condition considering the legally created world, it is based on the real issues where the purpose of the verses of judgments is the universal titles according to their evidences that are estimated to be in the predicated order. 7 - The martyr Al - sader had denied the legislation world, and the result of the two last points is that the problem of the delayed condition supported by considering the legally created world where it is for Al - Khoo'y by the considering of the legislation world and for Al - Sader it does not need searching as he denied the real world.8 - It had been proved that the delayed condition helps in correct some of the Usuli rules such as the restricted and unrestricted, suspended obligation and unconditional obligation. 9 - It had been proved that the delayed condition, as an Usuli rule is applied on many of the jurisprudential sections such as transactions, selling, marriage, wil and other
