Abstract:
تتناول هذه الدراسة المذاهب الفلسفية التي تستند عليها سياسة التجريم في بناء القاعدة الجنائية, وبالتالي تحديد منهج القانون الجنائي في التعامل مع المصالح الاجتماعية والاقتصادية والسياسية داخل الهيئة الاجتماعية, فمن المعروف ان تخطيط سياسة لا يكون بشكل اعتباطي, بل بتفحص المذاهب الفلسفية التي تحكم التجريم, وان الحكم على هذه السياسة بكونها ناجعة يكمن في بناء معيار يقوم على أسس فلسفية متنوعة, وهذا التنوع يجعل من القاعدة الجنائية قادرة على الالمام بالمصالح المعتبرة في المجتمع وبالتالي مد مظلة الحماية الفعالة عليها, والمذاهب الفلسفية التي تناولتها هذه الدراسة هي ذات المذاهب الرئيسة التي يقوم عليها التجريم, ويبنى عليها القانون الجنائي في مختلف الأنظمة الجنائية, وهي المذهب النفعي والمذهب الأخلاقي.
وقد شهدت سياسة التجريم في العراق تحولات كبيرة على مختلف الاصعدة, سواء على الصعيد الاجتماعي والاقتصادي والسياسي؛ ولما كانت هذه التحولات تستهدف القيم الاجتماعية والمصالح في المجتمع، وتعكس الواقع الاجتماعي والسياسي والاقتصادي السائد، نجد أن سياسة التجريم في العراق قبل ٢٠٠٣، تختلف عما هو عليه بعد هذه العام، وهذا الاختلاف لا يقتصر على الملامح العامة لسياسة التجريم فقط؛ بل كذلك يمتد إلى محاور هذه السياسة، و تبنى محاور سياسة التجريم على أسس فلسفية ينطوي عليها إفراط وتفريط، اذ نجد أن المذهب الأخلاقي يسود المحور المثالي لسياسة التجريم و يتم زج المذهب النفعي في هذا المحور في غير موضعه بالشكل الذي يجعل من القواعد الجنائية لا تنسجم مع الواقع الاجتماعي، لما يتضمنه من منظومة قيمية، ويستدل على ذلك في الإفراط بالحرية الفردية في بعض جوانب المحور المثالي، لذا فإن هذا الأمر يستدعي إعادة تخطيط سياسة التجريم بالشكل الذي يجعل منهج القانون الجنائي متسق مع المبادئ الدينية والقيم الأخلاقية الراسخة في المجتمع، مع عدم التفريط بالمعايير النفعية في الجوانب التي تحتاج بناء سياسة التجريم على أسس نفعية، بما يضمن تكامل سياسة التجريم، حيث أن بعض المصالح لا تكون فيها الحماية الجنائية فاعلة بالاستناد على المذهب الأخلاقي بل يتطلب الاستعانة بالمذهب النفعي على الرغم من مثالية محور سياسة التجريم، وهو ذات الأمر بالنسبة للمحور المادي الذي يتكون من المحور الاقتصادي والسياسي، فلما كان المذهب النفعي هو السائد في هذه المحاور، إلا أنه لا يمكن إهمال الحتمية الأخلاقية التي تفرضها المبادئ الدينية والقيم الأخلاقية الراسخة في المجتمع، فضلاً عن المذهب الأخلاقي يتم الاستعانة به هنا حتى نضمن تكامل سياسة التجريم في تجريم الأفعال وحماية المصالح المعتبرة، وهذا يتم من خلال إجراء توازن بين المذهب النفعي والأخلاقي، من خلال ترك لكل مذهب مساحة معينة من التجريم بما يلائمه من مصالح بغض النظر عن كون المحور مادي يطغى فيه المذهب النفعي أو المحور المثالي الذي يطغى فيه المذهب الأخلاقي.
لذا فقد قسمت هذه الدراسة على بابين, وكل باب فصلين, وقد استعرضت بشكل متوازن جميع مرتكزات موضوع البحث الأساسية والفرعية, حيث تناولت في الفصل الأول التوازن بين المذهب النفعي والأخلاقي في سياسة التجريم, حيث استعرضت ابعاد المذهب النفعي والأخلاقي في سياسة التجريم, اما في الفصل الثاني من هذا الباب فقد تناولت ماهية هذا التوازن, ومن خلال هذه الماهية تعرض الدراسة علاقة توازن المذاهب الفلسفية بسياسة التجريم, اما الباب الثاني فتستعرض هذه الدراسة مظاهر التوازن الفلسفي في المحاور الثلاث لسياسة التجريم, وهي المحور الاجتماعي والمحور السياسي والمحور الاقتصادي؛ لان التوازن بين المذاهب الفلسفية في بناء القاعدة الجنائية لا يقتصر فقط على المحور الاجتماعي او المثالي لسياسة التجريم؛ بل يمتد الى جميع محاورها, وقد توصلت الدراسة الى ان سياسة التجريم في العراق والوطن العربي تحتاج الى اعادة تخطيط في ظل التغيرات الكبيرة التي حدثت في المصالح الاجتماعية والاقتصادية والسياسية, الأمر الذي يتطلب معه اعادة النظر في المحور السياسي والاقتصادي والاجتماعي في سياسة التجريم.
