Abstract: اعتراض الغير كطريقة للطعن في الحكم الإداري يعتبر وسيلة نظمها المشرع للغير الخارج عن الخصومة لمنع امتداد أثر الحكم محل الطعن إليه، ورغم ذلك فهو موضع خلاف، تردد بعض الفقهاء والقضاء الإداري في الاعتراف بحق الغير في الاعتراض على الحكم الصادر في الدعوى، وانه ليس متفقا على الأخذ به طريقاً من طرق الطعن القانونية، امتنع في البداية بداعي أن أحكام الإلغاء تتمتع بالحجة على الكافة، ثم استقر قضاء مجلس الدولة الفرنسي بأن سوغ للغير سلوك الطعن باعتراض الغير، في حين تذبذبت أحكام القضاء الإداري المصري بين القبول و الرفض حتى استقرت على عدم القبول وجعل اعتراض الغير حالة من حالات (التماس إعادة النظر)، ولكن الوضع يختلف في العراق وإقليم كوردستان-العراق، إذ يحيط به غموض واشتباه بموقف المشرعين ما إذا أجازا اعتراض الغير أم لم يجزا،
