Abstract:
ان موضوع الاوامر الديوانية يثير الكثير من اللبس والغموض، ‏لا سيما وان ‏كثرة اصدار الاوامر الديوانية وارتباطها المباشر بالسياسة العامة للدولة ‏ومضمونها فهي في الغالب ترتبط في الوظائف الادارية العليا وهي التي تحمل في طياتها تكليف اشخاص واعفاء اخرين وقد تحمل في طيتها امور اخرى وقد تكون تنظيمية وقد تكون فردية، والصفة الغالبة على الاوامر الديوانية هي الصفة الفردية. تعد الاوامر الديوانية في العراق قرارات ادارية ‏تصدر عن مجلس الوزراء ‏بوصفها الجهة المختصة باصدار القرارات الادارية المختلفة سواء كانت قرارات ادارية تنظيمية او فردية، وتعددت الجهات التي تقوم باصدار الاوامر الديوانية فهي تصدر من رئيس مجلس الوزراء وتصدر من الامين العام لمجلس الوزراء وتصدر من مدير مكتب رئيس مجلس الوزراء فمن الجهة المختصة التي تقوم باصدار هذه الاوامر، وهل هذا يؤدي الى تضارب الاوامر الديوانية ويؤدي ايضا الى حدوث تنازع في الاختصاص بشان الجهة المكلفة قانونا باصدارها مع العلم ان النظام الداخلي لمجلس الوزراء رقم ٢ لسنة ٢٠١٩ قد جاء خاليا من النص على الاوامر الديوانية ومع العلم ‏انه لا يوجد هيئة ادارية تحمل تسمية ديوان ‏تابع الى مجلس الوزراء.‏ مما سبب الكثير من المشاكل فمن الجهة القضائية التي يتم الطعن امامها في صحة الاوامر الديوانية هل تدخل ضمن رقابة القضاء الدستوري ام القضاء الاداري، ‏وان المحكمة الاتحادية العليا قد كانت غير ثابتة على راي محدد بخصوص هذا الموضوع ففي بعض الاحكام قد قبلت النظر وفي احكام اخرى رفضت النظر في صحة الاوامر الديوانية مع الاشارة الى ان الدستور نص في المادة ٩٣/ ثالثا على اختصاصها بالنظر في صحة القرارات، واما القضاء الاداري فهو مختص بالرقابة على كافة القرارات الادارية ومن ضمنها الاوامر الديوانية بموجب قانون مجلس الدولة المعدل. ‏‏وكما سبق ان اشرنا بان الاوامر الديوانية ترتبط بالسياسة العامة للدولة وان مجلس النواب هو ممثل الشعب وهو الذي يحرص على تقيد السلطة التنفيذية بهذه السياسة التي رسمتها فان رقابة مجلس النواب على الاوامر الديوانية ما هي الوسائل التي سيستخدمها في سبيل تحقيق الهدف من الرقابة.

Abstract:
اعتراض الغير كطريقة للطعن في الحكم الإداري يعتبر وسيلة نظمها المشرع للغير الخارج عن الخصومة لمنع امتداد أثر الحكم محل الطعن إليه، ورغم ذلك فهو موضع خلاف، تردد بعض الفقهاء والقضاء الإداري في الاعتراف بحق الغير في الاعتراض على الحكم الصادر في الدعوى، وانه ليس متفقا على الأخذ به طريقاً من طرق الطعن القانونية، امتنع في البداية بداعي أن أحكام الإلغاء تتمتع بالحجة على الكافة، ثم استقر قضاء مجلس الدولة الفرنسي بأن سوغ للغير سلوك الطعن باعتراض الغير، في حين تذبذبت أحكام القضاء الإداري المصري بين القبول و الرفض حتى استقرت على عدم القبول وجعل اعتراض الغير حالة من حالات (التماس إعادة النظر)، ولكن الوضع يختلف في العراق وإقليم كوردستان-العراق، إذ يحيط به غموض واشتباه بموقف المشرعين ما إذا أجازا اعتراض الغير أم لم يجزا،

يُعَدْ المٌكَلّفون بخدمة عامة من أهم الركائز الأساسية التي تستند عليها الدولة، بل إنَّ أغلب فئاتها هم رأس الهرم في الوظائف العامة للدولة، لذا فإنَّ التشريعات الحديثة وبضمنها المُشرّع المصري والعراقي بدأ ينظم أحكامهم، وتبرز أهمية الموضوع من خلال تحديد مفهومه والذي لم يتطرق إليه المُشرّع الإداري في العراق، بل يبدو أنه قد اكتفى بالتعريف المحدد في قانون العقوبات العراقي رقم (111) لسنة 1969 المعدل والذي لا يواكب التطورات التي آلت إليه في مجال الوظيفة العامة بشكل عام، والذي غير كثيراً من المراكز القانونية لبعض الوظائف لتصبح ذات وصف مٌكَلّفة بخدمة عامة بعد أنْ كانت تتمتع بمركز قانوني مغاير، والذي أدى إلى الإختلاف في طبيعة العلاقة الوظيفية التي تربطه بالدولة.
وبالرغم من النقص الحاصل في التشريع إلّا أنَّ هنالك قوانين وأحكام تنظم طبيعة أعمال تلك الفئات من خلال تعيينهم، فقدد حددت شروطاً عامة قد تنطبق على جميع تلك الفئات بدون إستثناء وشروطاً خاصة للبعض منهم، وتكمن الشروط العامة بالصلاحية الجسدية لما لها من أهمية والتي تنعكس على عمله الوظيفي في حال إخلالها، كذلك فإنَّ المٌكَلّف بخدمة عامة يجب أنْ يكون من رعايا الدولة متمتعاً بجنسيتها حتى يكون ولائه للدولة ولا تُمارس عليه ضغوطاً خارجية، فضلاً عن تمتعه بالسمعة الحسنة والذي يتحقق من خلال عدم الحكم عليه بأي جريمة مخلة بالشرف، وتتطلب كل فئة منهم سناً معيناً ومؤهلاً علمياً خاص يكون بحسب طبيعة كل وظيفة. أما فيما يخص طرق إختيارهم فهنالك أسلوبان مختلفان، يكون الأول عن طريق الإنتخاب من قبل الشعب سواء أكان مباشراً أم غير مباشر، وأسلوب آخر يكون عن طريق الإدارة من خلال إختيارها الحر والمقيد وطريق المنافسة.
وإنَّ الإخلال بأي شرط من الشروط اللازمة للإختيار يؤدي إلى إنتهاء الرابطة الوظيفية له فضلاً عن وجود شروط أُخرى تؤدي إلى إنتهاء تلك الرابطة قد تكون بإرادة المٌكَلّف من خلال تقديمه طلباً بالإحالة إلى التقاعد الجوازي عند توافر الشروط اللازمة لذلك والإستقالة، وقد تنتهي الرابطة لأسباب إدارية كالتقاعد الوجوبي والإقالة.
