Abstract:
يعد المعرض السياحي من الانشطة التجارية التي ظهرت في العراق ومعظم الدول العربية من مدة زمنية قريبة والتي تتمتع بمواقع سياحية و طبيعية كثيرة ، وتعاني في الوقت نفسه من عدم استثمار فاعل لها على مدار السنة ، و كذلك نتيجة الاهتمام العالمي بنشاط السياحة كواحد من الانشطة التجارية التي يعول عليها في تعظيم الموارد المالية واستقطاب العملة الاجنبية وتشغيل الايدي العاملة ، اذا اصبح هذا النشاط ينافس الانشطة التجارية المعروفة كالصناعة لما يحققه من مردود مالي وفير .
وترتيبا على ذلك يلاحظ ان معظم الدول اصبحت تبتكر الوسائل اللازمة لتنشيط السياحة فيها على مدار السنة ، ومن بين الوسائل المهمة لتنشيط السياحة واستقطاب السياح تنظيم المعارض المتخصصة بالمنتجات السياحية في تلك الدول بمواسم معينة من السنة ، يكون الغرض من تنظيمها تنشيط السياحة وذلك بتعريف الجمهور المستهلكين من السياح بما يتوفر في تلك الدولة من اماكن سياحية وبما تقدمه من خدمات متعلقة بالنشاط السياحي ، كما ان تنظيم المعرض السياحي في الدولة الراعية له يعد حدثا سياحيا يستقطب جمهور الوافدين طوال مدة التنظيم .
ونتيجة لاهمية المعرض السياحي من الناحيتين النظرية والعملية يلاحظ ضعف منظومة التشريعات العراقية في معالجة احكام هذا النشاط مقارنة مع معظم الدول التي اتخذت خطوات فاعلة في معالجة احكامه ، وبالتالي نجد عدم كفاية التشريع العراقي في معالجة مفهوم المعرض السياحي وكذلك بيان احكامه القانونية والية حل النزاعات التي يمكن ان تثار بسببه ، اذا ما لاحظنا توفر العنصر الاجنبي في تنظيم ذلك المعرض مما يزيد الامر تعقيدا في معالجة الاحكام القانونية المتعلقة به ، لذلك سنبحث في هذه الدراسة مفهوم المعرض السياحي من ثم نبين احكامه القانونية وفقا للقانون العراقي والقوانين المقارنة معالجين اهم مكامن الضعف والقصور في التشريع العراقي .
