Abstract: عند العلم بجريمة ما، تتخذ جملة من الاجراءات الجنائية المنصوص عليها في قانون اصول المحاكمات الجزائية والعسكرية بغية التوصل الى مرتكبها الحقيقي، هذه الاجراءات تتوزع على مرحلتين، اولاهما مرحلة التحقيق الابتدائي وثانيتهما مرحلة التحقيق القضائي او المحاكمة التي تنتهي بصدور قرار الحكم في الدعوى. ولكن قد يعتري سير هذه الاجراءات تدخل ما بغية وقف سيرها اما بقانون العفو الصادر من رئيس الدولة او الصلح ما بين المتهم والمجني عليه او من قبل السلطة التنفيذية باستئذان وزير العدل من قبل المدعي العام وبالتالي يؤدي كل ذلك الى انقضاء الدعوى الجنائية. اذن وقف الاجراءات الجنائية، هو طريق استثنائي تنقضي بموجبه الدعوى الجنائية فيما اذا كان وقفا نهائيا وهو نظام قانوني جنائي اجرائي يستطيع بموجبه وزير الدفاع ان يوقف الاجراءات الجنائية ازاء المتهم العسكري وذلك لسبب متعلق بالمصلحة العامة كظرف البلد او الحرب. لقد تجسدت الغاية في اختيارنا لهذا الموضوع نظرا لما لهذه الصلاحية من ابعاد خطيرة وعظيمة تؤدي الى وقف سير العمل القضائي ولكونها تعد تدخلا من قبل السلطة التنفيذية متمثلة بمنصب وزير الدفاع في اعمال واجراءات القضاء العسكري وما ينشا عن ذلك من خرق وانتهاك لمبدا الفصل ما بين السلطات واخلال بضمانه مهمة من ضمانات المتهم في ان تكون قضيته منظورة من قبل القضاء
