Abstract: لقد سعت الكثير من الدول الى توفير حد اقصى من الحماية لحقوق الملكية الفكرية على المستوى الدولي والوطني، بما يضمن لصاحب هذه الحقوق ان ينتفع ماديا بثمرة انتاجه الفكري الذي بذل الجهد والمال والوقت في سبيل الوصول اليه، وهذا لا يتم الا من خلال منحه حقوقا استئثارية تمكنه من استغلال اختراعه او علامته التجارية، وان لا يسمح لاي شخص بالانتفاع المادي من تلك الحقوق دون الحصول على موافقة مالكها، مع ذلك لا يمكن ان تكون هذه الحقوق مطلقة، فقد يقدم مالك براءة الاختراع او العلامة التجارية على فرض قيود تحد من استخدام او اعادة بيع او استيراد المنتجات محل براءة الاختراع او العلامة التجارية التي سبق وان تم طرحها في السوق من قبل المالك مباشرة او من ينوب عنه، مما قد يؤدي الى اعاقة تداول تلك المنتجات بين الدول، ويتيح للمالك امكانية تقسيم الاسواق وفرض اسعار مختلفة بينها. | لهذا تبنت الكثير من الدول استنفاد حقوق الملكية الفكرية الذي يعد احد القيود التي ترد على الحقوق الاستئثارية المقررة لصاحب الملكية الفكرية، اذ تكمن الفكرة الاساسية من استنفاد الحقوق في انه بمجرد قيام صاحب الملكية الفكرية بطرح منتجه المحمي بحقوق الملكية الفكرية لاول مرة في السوق وتلقى مقابل ذلك ثمنه، فعندئذ يصبح هذا المنتج خاليا من اي حقوق استئثارية، ومن ثم لا يستطيع صاحب الملكية الفكرية منع اي شخص يتلقى ذلك المنتج من استخدامه او اعادة بيعه وتوزيعه الى مناطق اخرى، لان حقوقه في المنتج المحمي قد استنفدت، اذ ليس من العدل ان يسمح لصاحب الملكية الفكرية الافادة مرة اخرى بتكرر الربح بعد مكافاته بموجب البيع الاول للمنتج المحمي، والسبب في ذلك هو انفصال الملكية الفكرية عن الملكية المادية للمنتج. | مع ذلك، لم تتفق الدول على مجموعة معينة من قواعد الاستنفاد، فنجد ان الانظمة القانونية المقارنة اختلفت حول تفسير مفهوم الموافقة بين اتجاهين، الاول الذي اعتمدته محكمة العدل الاوربية التي ترى ضرورة ان تكن موافقة صريحة من قبل صاحب الملكية الفكرية على طرح منتجه في السوق، والثاني اتجاة بلدان القانون العام (النظام الانكلوسكسوني)، الذي يميل الى منح العقد دورا اكبر من الحرية في تقييد تصرفات ما بعد البيع، فاذا لم يتضمن العقد شروط لتقييد حق استيراد المنتج ، فعندئذ يمكن ان تستنتج موافقة صاحب الملكية الفكرية ضمنيا على السماح باعادة تسويق منتجاته الى دول اخرى يمتلك فيها حقوقا حصرية. | فضلا عن ذلك تعد مسالة تحديد معيار موحد يحدد النطاق الجغرافي لاستنفاد الحقوق من اكثر القضايا التي اثارت جدلا واسعا في التجارة الدولية، واحد اهم المحاور الخلافية التي حصلت بين الدول المتقدمة والدول النامية اثناء مفاوضات انشاء اتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية (TRIPS)، ونتيجة لهذا الخلاف لم يتم التوصل الى اتفاق عالمي يلزم الدول الاعضاء في منظمة التجارة العالمية بتبني موقف موحد فيما يتعلق باستنفاد حقوق الملكية الفكرية بصورة تمكن الدول الاعضاء ان التقرر بحرية ما اذا كانت ستسمح بالاستيراد الموازي او تحظره. |

Abstract: ان جريان الاحكام القرانية وانطباقها على مصاديق غير محدودة يعد صورة من صور تجلي مراد الله تعالى من انزال كتابه العزيز لهداية البشرية فكل مفهوم محمود اثنى علية القران الكريم ودعا اليه يكون مدعاة للاتباع وكل مفهوم مذموم مدعاة للاجتناب. وقد تضمن القران الكريم زخما كبيرا وحشدا هائلا من المفاهيم والمعاني العقائدية والتشريعية والاخلاقية التي اراد من الانسان الامتثال لها والتحلي بها ليكون مثالا للخلق النبوي والايمان الرسالي الذي اراده الله تعالى من عباده وجاءت هذه الدراسة لتقدم انموذجا عظيما من النماذج التي شربت فكر القران وتشربت كل عقائده واحكامه فظهر القران واضحا جليا على سلوكياته انه العباس بن علي ابن ابي طالب (عليهم السلام) فقد طرز اسمه باحرف من نور في صحائف التاريخ و ذلك لما اتصف به من نفاذ البصيرة وصلابة الايمان، فضلا عن ايثاره، وذوبانه في ذات الله، وفدائه بنفسه قربانا في سبيل الله تعالى بين يدي اخيه الحسين(عليه السلام)، فهو الممثل الوحيد انذاك للارادة الالهية في جعل الدين الاسلامي خاتمة الاديان السماوية على الارض.
