Abstract:
ان الروبوت الجراحي الذكي هو عبارة عن الة ذكية تستطيع القيام بمختلف الاعمال الجراحية، بدقة وسرعة متناهية، دون الحاجة الى تدخل فعلي من قبل الطبيب، وذلك بفضل السمات التي يتميز بها، والتي تمكنه من التعلم وادراك البيئة المحيطة به، اذ غدت هذه الالات قادرة على محاكاة السلوك البشري، فهي تعد من ابرز التطبيقات المادية لتقنيات الذكاء الاصطناعي، ونتيجة للسمات التي تتسم بها هذه الروبوتات فهناك بعض المشكلات التي بدات تظهر على الساحة القانونية، فقد اثير الخلاف حول المركز القانوني للاخيرة فهل هي تعد من قبيل الاشخاص او من قبيل الاشياء؟ وماهي المسؤولية المدنية التي تترتب على استخدامها؟ وهل تسطيع قواعد المسؤولية التقليدية احتواءها؟ ومن هو المسؤول عن الاضرار التي يتسبب بها الروبوت الجراحي الذكي للمريض؟ ولاسيما في ظل تعدد الاشخاص سواء من ناحية الانتاج او الاستخدام. وهل نظام التعويض الفردي قادر على جبر ضرر الذي يتعرض اليه ام ثمة حاجة الى تبني وسائل جديدة للتعويض؟ الامر الذي يستوجب دراسة الموضوع دراسة تحليلية مقارنة، بالاستعانة بالنصوص القانونية محل المقارنة والاحكام القضائية والاراء الفقهية، وذلك عن طريق بيان مفهوم الروبوت الجراحي الذكي، والتطرق الى الخصائص التي يتمتع بها، فضلا عن بيان المركز القانوني الذي يحظى به، ومن ثم الانتقال الى بيان المسؤولية المدنية الناشئة عنه، عن طريق بيان طبيعة مسؤولية المنتج والطبيب، ومن ثم بيان اركان تحقق تلك المسؤولية، وصولا الى الاثار المرتبة على تحقق اركان المسؤولية المدينة. سواء من جانب التطرق الى اثر الاتفاقات المعدلة على احكام المسؤولية وامكانية الاعفاء منها، او بيان مدى كفاية انظمة التعويض التقليدية لجبر الضرر الناشئ عن الروبوت الجراحي الذكي. وعليه توصلت الدراسة الى عدم وجود اتفاق حول مفهوم وطبيعة هذه الالات، وعدم فعالية قواعد المسؤولية المدنية التقليدية في حماية المريض من اضرار الروبوت الجراحي الذكي، وعدم كفاية انظمة التعويض في المسؤولية المدنية التي تضمن للمريض الحصول على تعويض عادل، الامر الذي يقتضي ضرورة تشريع قانون خاص بتطبيقات الذكاء الاصطناعي المادية، وضرورة تبني احكام قانونية مشددة للمسؤولية المدنية بعيدا عن فكرة الخطا؛ لاجل التصدي للاضرار الناشئة عن طريق الروبوت الجراحي الذكي، فضلا عن ذلك ضرورة الاخذ بالوسائل الجماعية للتعويض، بالاخص عندما يعجز نظام التعويض التقليدي عن جبر الضرر.
