Abstract: ان الامن البايلوجي للعامل يتمثل بمجموعة من الاجراءات والتدابير الوقائية الرامية للحد من المخاطر البايلوجية في بيئة العمل والتي يتعرض لها العامل اثناء ممارسته للعمل، فامن العامل من اهم الاولويات التي تقع على صاحب العمل كما ان تعدد المخاطر البايلوجية وخطورتها تتطلب جهد مضاعف من اجل الوقاية منها عن طريق وضع اجراءات قانونية وقواعد تنظيمية تكفل حماية العامل من المخاطر البايلوجية. وبذلك فان اخلال صاحب العمل بعدم توفير متطلبات الصحة والسلامة المهنية التي فرضها المشرع على صاحب العمل يعرضه لنوعين من المسؤولية، المسؤولية المدنية بنوعيها العقدي و التقصيري والتي يترتب عليها التعويض في حال توفرت اركانه من خطا وضرر وعلاقة سببية، اما المسؤولية الاخرى هي المسؤولية الجزائية في حال اخلال صاحب العمل باحتياطات العمل التي نص عليها قانون العمل العراقي رقم (٣٧) لسنة ٢٠١٥. كما يستحق العامل البايلوجي التعويض عن الاصابة التي يتعرض لها اثناء العمل او بسببه من قبل دائرة التعويض والضمان الاجتماعي وفقا للقانون، والتعويض الذي يستحقه العامل البايلوجي يكون على نوعين اما تعويضا عينيا او تعويضا نقديا وفي بعض الحالات يحصل على تعويض تكميلي. ومن اجل ضمان حماية العامل البايلوجي على المستويان الداخلي والدولي، اما الداخلي فاناط المشرع مهمة مراقبة نفاذ تطبيق القانون والتعليمات الخاصة بحماية العامل البايلوجي بلجنه اسماها لجنة تفتيش العمل ومنحت صلاحيات واسعه في هذا الشان، وكذلك احدى طرق حماية العامل على المستوى الوطني هو القضاء فانشئ المشرع العراقي محكمة خاصة للقضايا العمالية تضمن حقوقهم وتحميهم من تعسف صاحب العمل، اما على المستوى الدولي فان منظمة العمل الدولية لم تدخر جهدا في حماية امن العامل البايلوجي.
