Abstract:
اذ يضمن المشرع الدستوري نصوص الدستور مددا معينة، انما يبتغي من ذلك حماية المبادئ والاحكام التي تحتويها هذه النصوص بوجوب القيام بالاجراء او العمل او التصرف الدستوري او ممارسة الاختصاصات الدستورية خلال المدة الموصوفة له في الدستور، على اعتبار ان المدة الواردة في النص الدستوري هي الحد الفاصل بين الالتزام بالدستور والخرق الدستوري، او بين المشروعية الدستورية من عدمها، الا ان هذه المدد لا تحقق غاية المشرع الدستوري في حماية نصوص الدستور ما لم تكن المدة بذاتها محمية، وهو ما يتحقق عن طريق القضاء الدستوري، بما يمتلك من سلطة في حماية الاحكام والمبادئ الدستورية، فهو يمتلك السلطة في قضاء الدستورية وسلطة تفسير نصوص الدستور، وقد يوكل اليه المشرع الدستوري مهاما اخرى تتعلق بحماية الدستور، وبمناسبة ممارسة القضاء الدستوري لهذه الاختصاصات يحقق حماية المدد الواردة في الدستور عبر اصدار احكام باتة وملزمة للسلطات كافة. وتتحقق حماية المدد عن طريقين اما عن طريق طلب حماية هذه المدد مباشرة اذ يكون موضوع الدعوى الدستورية او التفسيرية هو حماية المدد الواردة في الدستور، او حماية احكام الدستور ومبادئه وبهذه المناسبة قد يمارس القضاء الدستوري حماية للمدد التي تحتويها النصوص الدستورية التي تحمل تلك المبادئ والاحكام المطلوب حمايتها من القضاء الدستوري. ولا يحقق القضاء الدستوري هذه الحماية للمدد الواردة في الدستور بيسر وسهولة، فقد يلجا في سبيل ذلك الى وسائل تفسيرية مختلفة ويسلك مناهج متعددة يقصد من وراءها استظهار ارادة المشرع الدستوري من المدد وامكانية تطبيقها على الوقائع المختلفة ، ويستخدم في كل ذلك الوسائل والمناهج التفسيرية التي يجدها منسجمة مع قصد المشرع الدستوري وغايته ، وبما يتلاءم مع الواقع والظرف المستجد بشكل يجعل من النص الدستوري قابلا للتكيف مع كافة الظروف والاحوال التي يمر بها البلد وقابلا للتطبيق في كل الاوقات بشكل يجعل من النص الدستوري اداة حية بيد المفسر الدستوري قابلة لمواكبة تطور المجتمع. حيث نجد القضاء الدستوري يكشف عبر احكامه عن الحدود الزمنية للمدد الواردة في الدستور من حيث ابتدائها وانتهائها وسريانها وما يطرا عليها من احوال، وما يترتب على مخالفتها من احكام السقوط او البطلان، او ما يستتبع ذلك من وضع تقديرات زمنية معينة من قبل القضاء الدستوري لتطبيق بعض المبادئ الدستوري التي وردت في الدستور غير مقترنة باجل زمني محدد.
