Abstract:
تعد مشكلة الاحتلال الاجنبي من اعقد المشكلات التي عصفت بالعالم الاسلامي لاسیما في الازمنة المعاصرة ، ومنشا هذه المشكلة هو الاطماع الدولیة في ارضه وخیراته، الامر الذي جعل الدول الاسلامیة في معرض الغزو والاحتلال سواء في العصر الحدیث ام في العصور الماضیة، وقد ذكرت كتب التاریخ مصادیق كثیرة من احتلال البلدان، لاسیما الاحتلال العسكري، ومنه احتلال المغول والبرتغالیین والهولندیین والبریطانیین والفرنسیین والاسبان والايطالیین والروس والامریكان لكثیر من البلدان الاسلامیة. ولم تكن هذه الظاهرة العسكریة والسیاسیة غائبة عن عین التشریع الاسلامي كونه شاملا للحیاة ومستوعبا للوقائع والاحداث، ویمتلك المادة الشرعیة لمواجهة الحوادث فما هو معروف ا ن الدین الاسلامي لیس دین المرحلة الواحدة، ولیس تشریع الزمن المحدد، والمكان المعین، بل هو دین شامل للزمان والمكان، ومن هنا كانت حركة الفقهاء تجاه الاحتلال ماخوذة من منابع الفقه الاسلامي ومنطلقة من ارضیته. یسعى البحث للتصدي لبیان ادوار الفقه الاسلامي وفقهاء المسلمین تجاه قضیة الاحتلال الاجنبي وبیان مناشئ الاحتلال وطبیعته وانواعه واسبابه ودواعیه وتداعیاته واثاره وتاریخه وجهود العلماء ومواقفهم منه واسالیب مقاومته والاحكام الشرعیة في موارده والادلة علیها في الشریعة الاسلامیة.
