Abstract:
تعدّ أنظمة تضارب المصالح من أهم آليات التصدي للفساد التي توصل جهود مكافحة الفساد من خلال تجريم صور الفساد في القانون الجنائي الى حقل القانون الإداري أي قبل أن تصبح جريمة, فهي حلقة وصل بين معالجة الفساد في القانون الإداري و القانون الجنائي, ومع تطور الإدارة العامة و أساليب الإدارة الحديثة تنحسر معالجة تضارب المصالح جنائيا لصالح القانون الإداري بشكل تدريجي. قوانين تضارب المصالح هي صيانة نزاهة الوظيفة العامة و حماية المصلحة العامة و تعزيز الثقة العامة من خلال تحسين علاقة الحاكم بالمحكوم وهي من أنقى صور تطبيق مبدأ الشفافية في الإدارة الحديثة. و إدارة التضارب الواقع فعلاً أو الذي سيقع في المستقبل, وليس منع تضارب المصالح في ذاته بإعتباره تعدياً على حقوق الموظف العام الدستورية الذي هو مواطن, لذلك تضارب المصالح يدار و لا يمنع,من هنا يأتي دور أنظمة تضارب المصالح في مساعدة الموظف و الإدارة في تجنب تصرفات منافية لأخلاقيات الوظيفة العامة, و التي تمثل سلوكاً إجرامياً, تجرمها القوانين العقابية, فليس مهمة المشرع إثقال كاهل الموظف العام بالالتزامات بل مساعدته على تخطي الفساد وإتخاذ قرارات سليمة عن طريق تنمية أخلاقيات الوظيفة العامة.
