Abstract: بحثت هذه الدراسة المعنونه (المسؤولية الجنائية الفردية الناشئة عن جريمة العدوان السيبراني)، مدى فاعلية التعديل الاخير لجريمة العدوان وتفعيل اختصاص المحكمة الجنائية الدولية عام 2017، ابتداء من 17 تموز عام 2018 ، بمعنى قدرة المحكمة على بسط ولايتها، على جريمة العدوان التي تقوم على هجمات سيبرانية ضد دولة او مجموعة دول، وهذا ما سعت الدراسة للبحث فيه ، والكشف عن اوجه التعارض، والنقص الذي يشوب مفهوم جريمة العدوان من جهة، والمسؤولية الجنائية الفردية الناشئة عن العدوان السيبراني من جهة اخرى. وكانت اهداف الدراسة بيان اثر تعديل نظام روما الاساسي في مؤتمر كمبالا 2010، على احكام المسؤولية الجنائية الفردية، وبيان امكانية تحديد معيار العدوان في المحكمة الجنائية الدولية من خلال المعايير الدولية المماثلة وخاصة المعايير الدولية في الفضاء السيبراني، وايضاح القيود التي تقيد المحكمة من ممارسة هذا الاختصاص، واثبات ان الهجوم السيبراني العدواني عملا عدوانيا ينتهك ميثاق الامم المتحدة، ويعرض السلم والامن الدولي للخطر، وله الاثر نفسه على احكام المسؤولية الجنائية الفردية الناشئة عن جريمة العدوان بالاعمال المذكورة في المادة (8 مكررا) من النظام الاساسي للمحكمة الجنائية الدولية. واتخذت الدراسة منهجا وصفيا تحليليا، لنصوص الصكوك الدولية، والعرف الدولي، والاحكام القضائية للمحاكم الدولية، فضلا عن المنهج التاريخي في دراسة تطور جريمة العدوان والمسؤولية الفردية الناشئة عنها. وباعتماد المنهج الاستقرائي، بحثت امكانية استخدام هذه النتائج في تحديد المسؤولية الجنائية الفردية الناشئة عن جريمة العدوان السيبراني. وجاءت الدراسة في فصلين ، الاول عنوانه: مفهوم العدوان في ضوء قواعد القانون الدولي العام ، اما الفصل الثاني فعنوانه: المسؤولية الجنائية الفردية الناشئة عن جريمة العدوان مع التركيز على العدوان السيبراني. فضلا عن ذلك ، خلصت الدراسة ، الى ان تعريف جريمة العدوان ضيق( كتعريف لجريمة بموجب القانون الدولي) ، وان الاختصاص القضائي للمحكمة على الجريمة (اكثر صرامة من المطلوب) وان المادة (8 مكررا) يشوبها الكثير من القصور في مطابقة اهداف نظام روما الاساسي والقانون الجنائي الدولي، وانماط النزاع المتطورة. الباحث
