المستخلص: Praise be to Allah , who perfected his glorious Qur,an, the falsehood cannot come at it from before it or behind it, it is a revelation from the wise , the owner of praise , and prayers and peace be upon the most honor of his messengers Mohammed and his virtuous family ,his faithful companions and those upon whom you (Allah) have guided them.Then : The human kind with his limited science is unable to know what is going to be after the elimination and abrogation for some rules , and God,s rules , that God alone knows before it occur. Many of people do not recognize the importance of abrogation and knowledge with it Mankind may not take the trouble to do research to avoid making mistakes , the subject is extremely intricate and should be drawn with great precision.Besides to plunge into this subject needs more of caution and characterized by distinctive efforts. After I had trusted in God, I determined to search in this field. So ,as a benefaction of God to me. He led me to go in search of the abrogation at Ibn Barhan ,the shafiitic scholar, in his book (Al Wusul ila Al Ausul ). And to compare his opinions with scholars 'opinions from other beliefs aiming to be fundamental comparative study. Research Plan : After I had trusted in God , I began research with introductioned mentioned the most important causes to choose this subject and the methodology that I followed in writing and the plan of research I acted up to it.Then I divided the questions into four chapter : Chapter one ; there are two themes : The first theme : In this theme I mentioned in it the biography of Ibn Barhan, and a summary of his book The (Al Wusul ila Alausul)The second theme : I display the opinion of Ibn barhan in the abrogation as a language and an idiom or an expression , and his opinion on moreover of the text.Chapter two , there are two themes in it : The first theme : The confirmation of abrogation in Divine laws at Ibn BarhanThe second theme : The difference between the abrogation and the appearance of hidden at Ibn Barhan.Chapter three : There are two themes in it : The first theme : Aspects of abrogation at Ibn Barhan.The second theme : The time of abrogation at Ibn Barhan.Chapter four : Parts of an abrogation at Ibn Barhan , and there are two themes in it : The first theme : The abrogation of Qur,an and the Sunna of the prophet Mohammed [peace be upon him ],at Ibn Barhan.The second theme : includes the abrogation of an unanimity analogy , tidings ,and the meaning. Conclusion,I mentioned the summary of the important results that I got through my research ,including; The Imam Ibn Barhan was intelligent , he was an ideal to solve the paradox which led him to be interested in rational proof.So, in his book prefers rational proof to traditional proof.It might be the reason that he turned from Al Hanbali belief to Al Shafiitic belief because the persons who follow Al Hanbali belief are interested in traditional proof and not pay attention to rational proof. There are some scholars who changed their belief like Al - Samaani who changed his belief from Al Hanafi to Al Shafiitic and Ibn Daqiq from Al Maleki to Al Shafiitic. Ibn Barhan wasnot fanatic about his al shafiitic belief , he disagreed with some of fundamental issues that I mentioned in (the Abrogation )..

المستخلص: The jurisprudence is considered one of most important Islamic Sciences since its subject - matter are divine rules that concern over organizing affairs of human life.The Islam scholars have exerted huge efforts for the sake of this science. Among of those scholars was "Imam Muqdad Bin Abdullah Al - Sayyuri dies in 826AH; he was an outstanding figure in the science in ninth century AH. This current study aims at bringing out the prominent scientific prestige for Imam " Al - Sayyuri" amongst the jurisprudents and scholars. In this study , I have dealt with his jurisprudent weights , making the section " transactions " as an example for his weights. The research includes an introduction, three chapters and conclusion.Chapter one : I have dealt with the personal life of Al - Sayyuri in respect to his name , his kinship, his surname , his death and his scientific biography. I have also showed his prestige among the scholars and the latter's praise over his volumes and his scientific effects; besides , it also includes definition of the subject linguistically. I have also referred to the methodology of "Imam Al - Sayyuri and utterances he has used , after then, I have dealt with opinions of jurisprudents and jurisprudent schools on which The Imam Al - Sayyuri depends. Chapter two : It includes jurisprudent opinions of Al - - Sayyuri in the domain of Selling , usurp and neighboring. Chapter Three : I have discussed Al - Sayyuri' s jurisprudent weights in different treatments which are ( mortgage , assurance , agency , remittance and gift. the number of jurisprudent matters has been 14 matters and the total has become 28 jurisprudent matters. I have exposed in conclusion most important results and I have indicated that Imam Al - Sayyuri is one of hard scholars and he is the most qualified for being most prominent jurisprudent figure during his age. Peace upon our Messenger "Mohammed " ,his family members and his colleagues.
