Abstract:
A study based on cuneiform sources Sumerian and Akkadian cuneiform texts relating to legal system in ancient Iraq show clearly that testimony was one of the main fine way which Babylonian judges depended on to prone any legal case. More ones, ancient Iraqi laws state exeplistly that any legal transaction should be recorded in front of several witnesses. This fact has resulted the discovery of hundreds of various economic, socialist and legal contracts. The first four sections of Hammurabi's laws deals mainly with falseness witness and describe the punishment to be inflicted on one who wrongfully and maliciously brings tales accusations against another. On the other hand, hundreds of legal texts, especially those texts which are known as dēnum gamrum which record cases that were seen by judges and decisions were decided, have been discovered in various sites showing the importance of testimony and witnesses in ancient Iraqi law. In spite of this importance, little has been written on this subject especially in Arabic, this fact had lead us to chose this subject for our thesis.The Destertation has dealt with the subject in four mains chapters, the first of which gore the meaning and vocabulary used for testimony and witnesses in Arabic and Sumerian Akkadian languages.The second chapter was dedicated for false witness and what mentioned about it in ancient Iraqi laws. The third chapter deal with testimony in front of judges or an legal contracts while the fourth and last section tackled the second main subject, i.e. witnesses their sex, male or female, number, craft or office and any other information about witnesses as can be known from written laws and legal texts
