Abstract:
Parse be to God, and upon Him, I rely and peace and prayer be upon Master of Prophet Mohammed and His household, the virtuous and his companions the best till the Day of Resurrection.God willing chose this Nation to be epilogue of Nations, and its message to be the epilogue of messages, and its Holly Book the conclusion of Books, and it's Canon the epilogue of Canons. Therefore God to Whom be ascribed all perfection and majesty, chose the top of His creation of Prophets and Messengers, Mohammed peace be upon him.God prepared for this Canon, Men who carry it, take care of it, preserve it and putting it across, since the time of Prophet Muhammad (peace be upon him), till the Day of Resurrection.Almighty God guarantee to preserve the Holly Koran and its Canon when he said "We have, without doubt, sent down the Message; and We will assuredly guard it (from corruption)"The Prophet Companions and Followers were the best who carried this Message, after the prophet (peace be upon him) as He said "the best century is Mine then those who come after them, then those who follow them".Then after that the Nation bore a number of scholars in different types of knowledge, especially those who specialized in Islamic Jurisprudence, which is the subject of our thesis. It is worth mentioning that the Islamic Nation depended, since long period, on Jurisprudence of some doctrines, especially Jurists of the Four Doctrines (Al - Hanafiah, Al - Malikiah, Al - Shafia'h and Al - Hanabilah).The most important reasons were that the Jurisprudence of those scholars was gathered and registered, either by the doctrine's Imam, or by his students.As my desire to facilitate the benefit of their opinions and their scholarship, and as a part of devotion for those great men who served the Islamic Jurisprudence specially and the Islamic Canon in general, I have chosen to actualize the last chapter entitled "The Summary of Al Fatwa" which belongs to a reputed of the Jurisprudence of Al - Hanafi, from the third class i.e. Al - Imam Iftikhar el - Deen, Tahir bin Ahmed bin Abdul Rasheed Al - Sarkhasi Al - Bukhari Al - Hanafi (died in 542H God blessing him). Author of a number of authoresses in Al - Hanafi Jurisprudence, and after consulting a number of our elders and our professors in the college, and taking their agreement on choosing this topic, and today after God awarded me to complete this thesis, I have the pleasure to record some results to which I have obtained ,and may God help me, which are as follows : 1 - The author name is Hafutheldeen Tahir bin Ahmed bin Abdul Rasheed bin Al - Husain Al - Sarkhasi Al - Bukhari, who was entitled Iftikhar el - Deen , or Al - Iftikhar Al - Bukhari.2 - The Imam was descended from a deep - rooted family well known in knowledge and leadership that he inherited from his father and mother.3 - A number of important authoresses in Al - Hanafi Jurisprudence belonged to this jurist , among them "Khizanet Al - Fatawa, Khizanet Al - Wakiaat, the book of Nisab Al - Faqih known in Al - Nisab and Kulasat Al - Ftwa, which is the subject of this thesis.4 - The author was born in (482H / 1090A.C) and died in (542H / 1148A.C).5 - The author is considered of the third class of opinion giving in issues to which there is no text found in doctrine possessor. The trust of scholars in him made them inclined to his opinions.6 - His work named Al - Khulasa (the summary), and it is really a summary in Al - Hanafi jurisprudence, because it gathers the judgments devoid of additions. He wrote in it the chapters and races at starting points of each book, so that it help those who research for advisory opinions.7 - The author method in his book, was Al - Ahnaf scholars method , who preceded him, where he depended the same known divisions that used to divide the jurisprudence topics like Kitab Al - Ghasub, Kitab Al - Wadeaa and others.8 - The author sometimes mentioned the opinions that were same in the issue without overbalancing, and in other time , he was overbalanced what he thought suitable.Finally, I pray to God accept this effort purely for God sake, and help me to serve his True Religion, and peace and prayer be upon Prophet Muhammad and household and companions.Ministry of Higher Education and Scientific ResearchIslamic University / BaghdadThe High Studies at the college of Canon and Law
