Abstract: ان بعض علماء المذهب المالكي الذين كانوا في وسط خصب ملئ بالمذاهب الفقهية الاسلامية - كما هو الحال في العراق - كانوا يؤلفون كتبهم الفقهية مدللة، مشحونة بالادلة؛ لانهم علموا بانهم لن يسلموا من الرد والمناقشة، فنجد بعض تاليف القاضي عبد الوهاب المالكي مليئة ب | Some Al - Malik?’s doctrine scientists, who were in a prolific milieu full of Islamic doctrinal schools as in Iraq, wrote their doctrinal books loaded with evidence for they were aware that they would not be free from repelling and discussion. Thus we find that some of the writings of the judge Abdul Wahab Al - Malik? are full of evidence and discussions on several other schools that contradict Imam Al - Malik’s (May God bless his soul). While the Lakhm? (May God bless his soul) has been considered one of the most important preponderance givers from Al - Malik?’s, I preferred to choose the subject of my study in Al - Malk?’s jurisprudence to survey an almost forgotten jurisprudence to Eastern people, to quaff from it, and to show its deepness and spaciousness.My method is to identify Imam Al - Lakhm? despite the little reported on him in his translation.Hence, I explore the preponderance terms for Al - Lakhm? through Al - Dusuq?’s retinue book; mention these different terms; present evidence for every term, and examine his preponderance methods with an example of each.Then, I display his preponderances within the different jurisprudence chapters, starting first with showing the opinion that Imam Al - Lakhm? preponderates, listing the jurists’ names who proclaim that opinion and those who agree with them from other known schools, mentioning the evidence they use, reporting the dissidents’ opinions with the available evidence, trying to find out the preponderant opinion through this study.The study is divided into an introduction, two chapters and a conclusion. The introduction contains an explanation for choosing this very subject and the method I follow.Chapter one, entitled “Imam Al - Lakhm? and his Method in Preponderating,” consists of three sections. Chapter two, under the title “Al - Lakhm?’s Doctrinal Preponderances,” treats four sections.The conclusion sums up the findings of the study
