Abstract:
State jurisprudence in Islam, in the shadow of contemporary changes is a research in the political jurisprudence of Islam. Islam as the last heavenly message has a u universal message to whole humanity.It’s not specified to any people, nation, language, time or place, but as it has come down brought a law to humanity and have marked some lines to be the original principles in order to people return to them at any time and place. The difference between Islam and other religions is that the other religions where bounded only by spiritual guidance rarely they have answered the cosmological questions.While the message of Islam behaves with all of the humanity as a human being that’s why there isn’t any question about live that Islam already hasn’t talked about it either directly or indirectly as Imam Shafi’i had said in his amazing book (the message) “There is no any event that happens unless it has been mentioned in the book of God”.It’s part of the nature of the messages that some may stand by their side and some stand against them. Obviously Islam is not an exception as it is from the beginning had been exposed to many threats from its enemies. They have been using too many ways to destroy this message from the beginning until nowadays.Since in every century the enemies of Islam tried to make doubts about the nature of this universal message and one of the topics that often they point to is nationality in Islam. There is no doubt that the western civilization has great impact on the Muslim society and culture.As from the western civilization history religion had played very bad role in the writing that history. The enemies of Islam are now trying to apply the same definition and same understanding for Islam which is obviously is a great mistake and misunderstanding.As in Islam the management of people and society are part of the duties of Muslims even some of the Muslim scholars regard them as a mandatory. As the society cannot be run in the absence of a general laws that has been mentioned in the Qur’an and Hadiths. Even the laws are not fully detailed in every aspect so as to be emendated according to the time and place.Nationality had been apparently seen in the time of the prophet (Peace be upon him) as he made a nation in Madinah (according to today’s standards) that has people and law.It had its own constitution, and after his death the continuation of the nation was done by the companions. It’s unwise to look at the Islam as the same as the other religions since if the principles of the nationality were removed in the Islam many statements will be meaningless.That’s why all of the modern changes are treated according to the law that has been provided in the texts. Justice, equality, and freedom are to be provided, and there will be protection of the nationality, mentality, wealth, and religion of all of the people.If there was these criteria it can be called a nation of the justice and humanity.
